I've discovered that somebody has taken some material word for word from an
old personal website of mine, no longer up, without ever having sought my
permission to do so. However, he's added various bits of wording on his
site which make me wonder whether I have a case for plagiarism against him,
and I would like to ask what you guys think.
This is where my material is reproduced:
http://www.exkiap.net/articles/miscellaneous/kuru.htm
The words in the body of the article are mine exactly, though he has topped
and tailed it (apparently with FP), and added my old domain name as source
at the top. What I need to know though is whether his statements on his
copyright page either lessen or worsen his plagiarism (his copyright link is
right at the bottom of the Kuru page.) Should he nevertheless have asked
for permission to use my stuff? My own copyright statements did appear on my
old site.
I emailed him 10 days ago at the contact address for the site, and also more
recently at his personal email address, revealed via Whois enquiries, but so
far have received no reply, which doesn't exactly make me feel more
charitable towards him.
Any thoughts? Should I complain to his host in the absence of any response
from him?

If he's taken material word for word from your site, that's
plagiarism. Doesn't matter if he's added his own words, he's still
using yours without permission.

Yes. First make a copy to your hard disk plus printout of his site.

PLEASE don't do that. We get "Someone on your servers stole my site!"
complaints....and generally reply with "Prove it.". I have yet to have
even one person be able to prove that their content was stolen. If you
can't prove it, don't bother the host.

True, however, the OP's orginal site is no longer up, so prove it that he
orginated the article and that there was not an exclusion for non-profit use
etc., etc......
We know he wrote the article only because he claims he wrote the article.
All in all, I'm not sure it's worth the OP's time to pursue the issue.

I have a similar problem and have found no legal solution. Don't bother
unless they're made of money ... it's not worth it.

Did you fail to read the post?

The site admits the work was stolen. It doesn't sound like fair use.

Of course it's rude to just copy somebody else's article. And it's even
more rude not to reply to your e-mail. On the other hand, perhaps he's
simply on a couple weeks of vacation, and he hasn't even read your
e-mail yet?
And what are your goals in this case? Do you want more appropriate
author attribution (with your name on it, a link to your current site?),
do you want to be paid for the use of your content, do you want him to
remove the article?
If you want compensation, simply send him a bill over whatever $$ you
consider appropriate, together with a polite yet perfectly clear letter.
If he doesn't pay (or remove the content) within 30 days, you can still
consider legal action, although that's most probably more hassle than
it's worth.

still own the domain from the old website? Or is it easily attributable
to yourself? If so, check and see if the internet archive has your site
archived (www.archive.org/web/web.php). Then you can start to build your
case by capturing his website to your hard drive and emailing him
stating you know he stole the information and the url to your old site
on archive.org. If still no response, you could then contact his host.

Did you fail to read Tina's?
Crediting a source does not constitute admission of theft.
Tina is perfectly correct. It is not the job of a host to decide on
copyright theft, that's what we have courts for.

If a host wants to use the "safe harbor" provisions of the DMCA it very
much is in their interest to disable access to material upon reception
of a valid take-down notice. Otherwise they can be liable for the
copyright infringement of their customer.
