Do not purchase server space from Globat web hosting service!

Globat.com practices what I consider to be unfair business methods. If
you sign up for a year, you will find that at the

end of that year, without so much as a renewal letter, they will bill
you for an additional year. A couple of days

later, they will cut off your service.

If you call them to cancel, they will not communicate that there is
only ONE way to cancel, to use their cancellation

request form. You will think that you are officially cancelled.

Six months later, without so much as sending you a bill, they will
submit you to collections, for the amount of $267.45.

Glob@t's rate is $94.45/year. The email and call from the
collections people become rude and annoying.

What's unfair about a clear, plain-English contract term? Globat's Ts&Cs
clearly state "After the Initial Term, this Agreement shall automatically
renew for successive terms, equal in length to the Initial Term, unless
terminated or canceled by either party as provided herein. During the Term,
and other as specified herein, this agreement cannot be terminated by
customer for any reason.

3.2 - This agreement may be terminated by either party at the
renewal/anniversary date by giving the other party notice at least 15 days
prior to the renewal/anniversary date of the Term (Customers need to use the
Cancellation Request Form at https://order.globat.com/cancel/cancel.cgi), or
by Globat in the event of nonpayment by Customer or by Globat, at any time,
without notice, if in Globat's sole judgment Customer has in any way
breached this Agreement (Termination for Cause)."

They told you what they would do, and they did it.

I disagree. Not all contract terms are enforceable.

In this case the provider is trying to make it as difficult as possible
to terminate the contract. Claiming that the only time the contract can
be terminated is 15 days prior to the end of the term and that the only
way the contract can be terminated is in the manner specified by the
provider is not enforceable.

The contract can be terminated at any time prior to the end of the
contract period by notifying the provider in writing by registered
letter. There would of course be no refund of the unused portion of the
contract period. The customer can also (in writing, by registered
letter) specify that the account should not be renewed at the end of the
current contract period.

One need not rely on the courts to settle a matter like this. All credit
card companies (in the US at least) will issue a chargeback if a
merchant has posted a charge after they have been notified by registered
letter that the customer desires that the contract be terminated.

Actually, it says "at least 15 days...". Here in the U.S., such clauses
are enforceable. And if the credit card company does issue a
chargeback, the company would have legal cause to sue him.

The same is true with the registered letter. If it isn't received by
the company at least 15 days prior to the contract termination, they can
legally renew the contract at the agreed upon price.

However, it also seems that Globat may have terminated the contract
itself by cutting off service ("non-payment by customer..."). In this
case he would have to agree to a new contract, as the old one is no
longer enforceable.

In the latter case, Globat may not have much of a legal basis for the
charge, as he indicated they did not notify him of the charges beforehand.
