Post subject: Copyright question?
Archived from groups: alt>www>webmaster (more info?)

Firstly is there anywhere online I can check the copyright of someone in
Australia
like I can here with US copyright?

Secondly I get this request from a gentleman asking me to credit him for a
poem
I put on my site as written by author unknown.

The reason I listed it as Author Unknown is because a search of it showed
several different authors as being the creator including...

Sam Levinson
http://halife.com/halife/beautywoman.html

Maya Angelou
http://members.rogers.com/heartandsoul/Soul/beautyofawoman.htm
http://www.fortunecity.com/marina/westferry/2106/page11.html
http://doorway3.tripod.com/woman.html

And here they say they have the copyright to it:
http://www.thewomenscafe.com/authors/beauty_of_a_woman.htm

But I did find one instance of it where it says he wrote it:
I did find one instance of it credited to you here:
http://www.friendshipquilts.com/quotes024.htm

So now what?

Heidi

So your saying you didn't create the poem and somebody else did. You can't
just take poems that somebody else created and put it on your site with out
permission (even if they are unknown). It's like someone taking your website
design and using it for their website design with out your permission. You
should know better then this Heidi, that your using someone else's
copyrighted material or is there more to this story.

Those tools are only useful if that person has registered their copyright,
which is something that they are neither required or indeed tend to do.

remove the poem and duck the issue

- or -

make a page containing the info above detailing all the relevant claims.

- or -

credit it to matey and then deal with the flak as the others chime in with
their tuppence worth.

You could ask him if he can prove he holds the copyright and also why he
doesn't go after the other people. Andrew Kingston doesn't come up on any
Google search.

I suppose if he has a decent answer I'd give him the credit. You have to
figure it must be his if he is going to this much trouble.

Since you do not need to register copyright, I can't imagine how you could
search for it.

I would give the guy the credit, why not?

If they are unknown I don't see the problem with it.

If I wrote something, and yes I am a writer, and wanted
to remain unknown I would not then turn around and complain
if someone put it on their website as long as they stated the author
was unknown.

If they tried to say they wrote it then yes I would complain and loudly.

I suppose your right but after dealing with that moron
over use of a name he didn't have the trademark to but
swore up and down he had the copyright on...

I am just tired of people saying this or that, making
threats with no legal proof to back it up.

Didn't realise it was that guy. Tell him to **** off and remove the

No AFAIK it isn't the same guy although it very well could
be...

He has still been hassling me even though I changed the name
in hopes he would just go away and leave me alone.

No this is a different person but after dealing with that guy I am
a bit more pissy than usual. *grin*
