I'm a freelance web designer and I'm having trouble getting content
from a client. Their ecommerce site was ready to go over 5 months ago.
I've been bugging them ever since for content (text descriptions &
pics), yet I keep getting various excuses from them about not sending
it.

I did not have this client sign a contract (yes, I know that was a BAD
idea) but they did verbally agree to a 50% deposit up front with the
balance due upon the site's completion. I'd like to move forward with
this client but I'm not sure which approach to take to motivate them
further.

Any suggestions?

Then you really have no recourse. However, you have learned a good lesson.

Never state "upon completion". I learned this lesson years ago, when a
client kept having me do little tweaks here and there...and wouldn't pay
because, technically, the site wasn't done. I dont remember if I ever did
get paid.

Now, my contracts always state that the balance is due within a certain
number of days or weeks...depending on how big the project is. Because of
this, the clients have a huge incentive to make sure they get me the
information I need.

Ring them up and tell them that you want to be paid, but because of the
agreement you can't get paid until the site is done...and you can't get the
site done until they get you the information you need. Then tell them
that's not entirely fair. It's really quite obvious and simple.

Every contract I use has this clause:

11. In the event that all information to be posted on the website is
not delivered to (my company) within 60 days of contract signing and
receipt of deposit, (my company) has the sole discretion to immediately
cease web design work, suspend web hosting service (where applicable)
and/or terminate this contract. All paid deposits will be retained as a
contract termination fee.

I've invoked this clause 3 times in the past 5 years. The first two
resulted in my retaining the deposit and not completing the site. To
this day, both of those companies do not have websites. The third time
I invoked the clause was all I needed to prompt that company to get the
materials to me within a couple days.

we've all been there. like the group suggests, your protections have to be
built into contract or there is nothing you can do.

annotate and archive your work to date so it's easy to pick up where you
left off when, a year from now, they activate the project again.

in the future, your contract should identify what content they have to
deliver by what date, that you are not legally responsible for this content
on the web and what the ramifications of failure to deliver are.

Create mockups and let them point out your errors? Some people would
rather correct someone else's efforts even if that is more work than
doing it themselves.
