Post subject: Advice?
Archived from groups: alt>www>webmaster (more info?)

Hello,

We are in a bit of a sticky situation here. Let me explain:

We had a client sign up for hosting with us ( www.xoticpc.com ), he ordered
a year of hosting at 160$, and used a service called www.bidpay.com to send
a money order. The problem is, the money order never went through, I would
assume the guy cancelled it. Anyways, with an agreement with him, we spent
2 hours setting up his site on our new server for him. He was satisfied and
used our services for a period of about 1.5 weeks. We then checked the DNS
records for his site, and we found he had switched to a new hosting
business. We contacted him asking about this, and he said he didnt do it
and it was a mistake somehow and that he would change it back immediately.
However 1 week later its still the same.

Now we are unable to contact him, I would assume he is ignoring us. When he
signed up for our hosting and agreed to our terms, he was bound to a
contract that says he must pay for all services used up until he sends a
cancellation email to us, which he never sent a cancellation to us.

We have lost close to 50$ now from this guy, because he never paid us for
our services and has moved to a new host. He has switched hosting providers
4 times in the past 2 months, which makes me assume he has been playing
around with hosts like this for a while, and just keeps moving around. What
else, he is banned from paypal (I would assume for non payment in the past).

What would you advise? We have sent him an email explaining all this and
requesting payment for the services used or we may take action, and report
his *business* ( www.xoticpc.com ) to the appropriate authorities. So far,
no reply.

Thanks,
Dan

What does bidpay.com say? How did he place the order and not pay? If you
never received payment why did you start providing services?

How did you lose $50? I wouldn't waste anymore money on it.

I don't know what you'll get out of that.

You should NEVER setup a hosting account until the funds arrive. I'm sure
Bidpay notified you that the payment was pending, and not actually cleared.
Correct?

At any rate, you've cancelled him now. Consider it a lesson learned and
move on. Time is money.

Write it off to being too trusting and don't let it happen again.

The guy changed his mind because he had an opportunity to screw you and took
advantage of it. Next time, don't trust anyone till you get paid, no matter
what sob story they give you.

Just proves the point.... no money.. no service.

You may never get a dime from this type.. but than again you can try in small claims court.
